Kabuzz, LLC ("Kabuzz," "we," "us," or "our") respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect your personal information when you use the Kabuzz marketplace platform at kabuzz.com, the Kabuzz API, and related services (collectively, the "Platform").
By using the Platform, you consent to the practices described in this Privacy Policy. If you do not agree, please do not use the Platform.
Account Information: When you create an account, we collect your name, email address, and password. If you register as a seller, we collect additional information through our payment processor, Stripe, Inc. ("Stripe"), including your legal name, date of birth, address, the last four digits of your Social Security Number, and bank account information for payouts.
Profile Information: You may optionally provide a display name, profile photo, and link social media accounts (such as Twitter/X, Facebook, or Google) to enhance your reputation profile.
Listing Content: When you create a listing, we collect the photos you upload, item descriptions, pricing information, and other details you provide. If an AI agent creates listings on your behalf, we collect the same information.
Transaction Information: When you make or receive a purchase, we collect details about the transaction, including item purchased, price, fees, shipping address, and tracking information.
Communications: Messages you send through the Platform's messaging system, including messages sent by AI agents on your behalf.
Support Inquiries: Information you provide when contacting our support team.
Usage Data: We collect information about how you interact with the Platform, including pages viewed, features used, search queries, and actions taken.
Device Information: Browser type, operating system, device identifiers, and screen resolution.
Log Data: IP address, access times, referring URLs, and error logs.
Cookies and Similar Technologies: We use cookies and similar tracking technologies to maintain your session, remember your preferences, and analyze Platform usage. See Section 7 for details.
When AI agents access the Platform on your behalf, we collect information about agent actions, including API requests made, transactions initiated, spending control evaluations, and any errors or rejections. This information is stored in your audit trail and is accessible through your dashboard.
Payment Processor: Stripe provides us with limited transaction and identity verification information necessary to operate the marketplace.
Social Media Platforms: If you link social media accounts, we receive limited profile information (such as account age and display name) from those platforms for reputation verification purposes.
Shipping Carriers: We receive tracking and delivery confirmation information from shipping carriers for orders placed on the Platform.
We use your personal information for the following purposes:
Platform Operations: To operate, maintain, and improve the Platform, including processing transactions, facilitating communication between buyers and sellers, and managing user accounts.
Identity Verification: To verify your identity through Stripe for seller onboarding and enhanced verification when required.
AI Services: To generate listing descriptions, categorizations, and pricing estimates from photos and information you provide using our AI systems.
Spending Control Enforcement: To evaluate and enforce spending controls on AI agent-initiated transactions.
Trust and Safety: To detect and prevent fraud, enforce our Terms of Service, and maintain the integrity of the marketplace. This includes monitoring for anomalous agent behavior, counterfeit listings, and other prohibited activity.
Communications: To send you transactional notifications (order confirmations, shipping updates, dispute notices), security alerts, and service announcements. We may also send promotional communications with your consent.
Tax Compliance: To generate and file required tax documents (Form 1099-K) for sellers meeting applicable thresholds.
Legal Compliance: To comply with applicable laws, regulations, legal processes, or governmental requests.
Analytics: To analyze usage patterns and improve the Platform's features and performance.
When you participate in a transaction, certain information is shared with the other party. Sellers see the buyer's shipping address. Buyers see the seller's display name and reputation information. Both parties see transaction details relevant to their role. Messages exchanged through the Platform are visible to both participants in the thread.
We share information with third-party service providers who perform services on our behalf, including:
Stripe, Inc. — Payment processing, seller identity verification (KYC), payouts, and fraud detection.
Cloudflare, Inc. — Content delivery, image storage (Cloudflare R2), and security services.
Google LLC — AI services (Gemini Vision) for listing description generation and categorization.
These providers are contractually required to use your information only to perform services for us and to protect your information.
We may disclose your information if required by law, regulation, legal process, or governmental request, or if we believe disclosure is necessary to protect the rights, property, or safety of Kabuzz, our users, or the public.
If Kabuzz is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change and any choices you may have regarding your information.
We may share your information with third parties when you have given us explicit consent to do so.
We retain your personal information for as long as your account is active or as needed to provide the Services. Specific retention periods include:
Account Information: Retained for the duration of your account plus 2 years after account closure.
Transaction Records: Retained for 7 years after the transaction date for tax and legal compliance.
Agent Audit Trail: Retained for the duration of your account plus 7 years after account closure.
Listing Content: Active listings are retained while published. Sold or removed listings are retained for 2 years for dispute resolution purposes.
Messages: Retained for the duration of your account plus 1 year after account closure.
You may request deletion of your data subject to our legal retention obligations (see Section 6).
You may request a copy of the personal information we hold about you by contacting us at privacy@kabuzz.com. We will provide your data in a structured, commonly used, machine-readable format.
You may update your account information through the Platform at any time. For information held by Stripe, you may update it through the Stripe-hosted dashboard accessible from your Kabuzz account.
You may request deletion of your account and personal information by contacting us at privacy@kabuzz.com. We will delete your information within 30 days, except for data we are required to retain for legal, tax, or compliance purposes.
You may opt out of promotional communications at any time by clicking the "unsubscribe" link in any promotional email or by updating your notification preferences in your account settings. Transactional communications (order updates, security alerts) cannot be opted out of while your account is active.
The Platform does not currently respond to "Do Not Track" browser signals. We honor opt-out requests made through the methods described in this section.
We use the following types of cookies:
Essential Cookies: Required for the Platform to function, including authentication, session management, and security. These cannot be disabled.
Analytics Cookies: Help us understand how the Platform is used so we can improve it. You may opt out of analytics cookies through your browser settings.
We do not use advertising or third-party tracking cookies. We do not sell your data to advertisers.
We implement industry-standard security measures to protect your personal information, including:
Encryption of data in transit (TLS 1.2+) and sensitive data at rest.
Secure storage of passwords using bcrypt hashing.
API key hashing (Agent API keys are stored as SHA-256 hashes, not in plain text).
Rate limiting and anomaly detection on API endpoints.

No security system is impenetrable. While we strive to protect your information, we cannot guarantee absolute security. You are responsible for maintaining the security of your account credentials and Agent API keys.
The Platform is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from children. If we discover that we have inadvertently collected information from a child under 18, we will promptly delete it.
The Platform is currently available only in the United States. If you access the Platform from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country.
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):
Right to Know: You may request disclosure of the categories and specific pieces of personal information we have collected about you.
Right to Delete: You may request deletion of your personal information, subject to certain exceptions.
Right to Opt-Out of Sale: We do not sell your personal information. No opt-out is necessary.
